COMMITTEE ON PRIVILEGE AND TENURE
Annual Report 1998-99
To the Academic Senate, Santa Cruz Division:
During the course of the year, the Committee on Privilege and Tenure (P&T) met several times, and, in addition, held one formal hearing. The committee was also represented at each of the three systemwide UCP&T meetings.
POLICY
The committee began to review several aspects of the disciplinary policy (APM 002.015) now in place at UCSC. Based upon our experiences during the year, we identified several areas where changes might be appropriate, and we anticipate completing this review during 1999-2000.
In response to two inquiries from departments, we provided feedback on whether proposed departmental policies and procedures would be consistent with the rights and privileges of faculty within the departments.
P&T also provided input to UCP&T on several matters. We commented on the proposed new Policy on Termination for Incompetent Performance (APM-075), on proposed revisions of Senate Bylaw 335 dealing with faculty grievances and discipline, and on the mechanisms being put in place for providing legal expertise to P&T committees on campuses without law schools.
GRIEVANCE
P&T and the Committee on Committees jointly proposed legislation (which was subsequently passed by the Senate) to establish a group of P&T Advisors. The P&T Advisors are a group of faculty, usually with experience on P&T, who are available to provide advice and assistance to faculty who believe that their rights and privileges may have been violated. These advisors can help faculty members determine if they have a viable grievance, and they can also provide help to faculty in preparing and filing a grievance complaint with P&T.
During the year, we received two formal grievance complaints. One was received so late that it was held over until 1999-2000. After considerable investigation and discussion of the other complaint, P&T submitted its recommendations to the administration late last spring. We have received a partial response from the administration, and will follow up on this matter.
We also brought to the attention of the administration and made certain informal recommendations regarding another matter. However, the committee did not feel it had jurisdiction to investigate and hold a formal grievance hearing regarding this matter.
DISCIPLINE
During the year, Executive Vice Chancellor Simpson initiated formal disciplinary action [in the sense of UCSC APM 002.015 (E)] against two members of the faculty. To help deal with the legal issues involved in real cases of proposed faculty discipline, P&T was able to recall Emeritus Professor Dick Wasserstrom with funding from the administration, to provide legal assistance to the committee. The
committee is extremely grateful to Professor Wasserstrom for his help and advice during both pre-hearing and hearing phases of these cases.
During the Spring of 1999, P&T held a formal hearing on one of these two disciplinary cases (the other case was carried over to 1999-2000). Incidentally, this represents the first formal disciplinary hearing at UCSC in more than 15 years. P&T constituted itself as the formal hearing committee (excluding one member because of academic affiliation), and we issued a formal report to the Chancellor during the summer. The Chancellor's decision in this matter was in accord with the report of the hearing committee.
